What is the ‘arraigo’ procedure?
The “arraigo” (or “tie”), is a residence and work authorization for exceptional circumstances.
How many types of “arraigo” exist in Spain and who can request them?
There are the following types of procedures of this type:
Arraigo Familiar:
Fathers or mothers of Spanish children, spouses or de facto partners of Spaniards or their ascendants over 65 years of age, and minor descendants in charge of a Spaniard can request it. In other words, the ID cards that were previously processed as EU citizen family cards are now transferred to the arraigo. The children of a father or mother who were originally Spanish may also request it.
Arraigo Social:
It is the most used regularization route by those people without a residence authorization or who had it, but lost it, and that have remained in Spain irregularly. There are 3 ways to access it: having a job offer, preparing to develop your own activity or having your own financial means or those of a family member. Three years of permanence in Spain are required.
Arraigo Laboral:
In this case, it will be necessary to have lived in Spain for two years, find yourself in it irregularly at the time of the application, and during this period have been working legally for at least 6 months. This employment relationship must meet the minimum working hours and salary.
Arraigo para la formación:
It is the new figure introduced by the Immigration Regulations of the 15th of August of 2022 to allow people who have been continuously in Spain for two years in an irregular situation. These foreigners must prove that they have no criminal record both in Spain and in their country of origin and pledge to carry out specific training leading to professional certifications or authorization to exercise the list indicated by law.
