In addition to highly qualified individuals, there is another group of people who can also apply to come to Spain to work from their non-European country. These are individuals whose personal circumstances and professional activity to be carried out in Spain, meet the requirements of the initial authorisation for temporary residence and employment. Not everyone can apply for it, because it is limited to certain activities and groups. But one should be aware of it.
More common than the initial application from the country of origin to obtain said authorisation, are the modifications of other types of authorisations to allow employment eligibility. Here are some of its characteristics: The initial authorisation for temporary residence and employment will have a duration of one year and will be limited to a specific geographical area and occupation.

Requirements
Regarding the hiring of foreign workers:
– They must not be in Spain irregularly.
– They must not have a criminal record.
– They must have the necessary skills and/or qualifications for the activity for which they are going to be hired.

Regarding the development of activities:
– The National Employment Situation (SNE) must allow the hiring of foreign workers, except in some cases such as regrouped family members, refugees, etc.
– The employer must provide an employment contract signed by both parties, guaranteeing the worker continuous employment during the validity period of the authorisation.
– The working conditions must comply with the regulations.
– The employer must be up to date with Social Security payments.
– The employer must have the necessary means.

Processing of the authorisation:
It is the Autonomous Communities that receive and process the applications for this type of initial authorisation. It is also important to keep in mind that the initiator of the procedure will be the employer who wishes to hire a non-resident foreign worker.
